<p>he nation is scheduled to hear a drunk driving case from new mexico. and the decision could have a major impact on how dwi cases are handled. jeremy jojola here with a rundown of what&#8217;s being looked at, and why it has prosecutors worried. jeremy. it&#8217;s a five year old drunk driving case from the four-corners now at the supreme court. and if the judges rule a certain way, prosecutors fear drunk driving cases will take longer to prosecute..and cost tax-payers more money. his name is donald bullcoming of farmington&#8212;in the eyes of new mexico, he&#8217;s a minute thumbnail 06:15 pm drunk driving convict&#8230; his case upheld by both new mexico&#8217;s court of appeals and the state&#8217;s supreme court. but now his case has reached the us supreme court. his attorneys argue that the analyst who tested his blood alcohol level at .21</div>

<p>Bloomfield Police say they arrested Joe C. Martinez, 59, for drinking and driving Wednesday afternoon, and it was his 18th DWI arrest. Officials say they believe all 18 arrests happened in San Juan County. Police say they pulled Martinez over on Saiz Lane for speeding around 2:30 pm The police report says his eyes were blood shot and he blew twice the legal limit. &#8220;I think there are numerous reasons we can contribute to him being out on the road,&#8221; Bloomfield police chief Mike Kovacs said. &#8220;I think it&#8217;s unfortunate that someone with this many DWI&#8217;s is more of a career alcoholic and it&#8217;s going to be hard to change that behavior.&#8221; Chief Kovacs says it&#8217;s unfortunate that there may have been a lapse or issue somewhere between incarceration and treatment in Martinez&#8217;s history. Police say Martinez was booked and charged for third degree felony DWI, driving with a suspended or revoked license, speeding, and driving with an open container. Officials say Martinez was last arrested for a DWI in 2007. His first time was nearly 40 years ago. Police tell Eyewitness News 4 that Martinez has been convicted of DWI at least seven times.</div>

<p>new mexico has been trying to shake it infamous reputation for dwi crashes and deaths. but tonight we&#8217;ve learned it could soon become the home of the nation&#8217;s first and only d- wi victims&#8217; memorial. jeff maher is here to explain why many say that&#8217;s a good thing. jeff. the memorial of perpetual tears has been in minute thumbnail 10:15 pm moriary for the past four years &#8212; it&#8217;s a statewide dwi memorial that is set to become a national one. and that in itself could help save the memorial from being forced to shut its doors for good &#8220;he was a horseman, he was a skier, he was a musician, multi-talented&#8221; in 1991, sonja britton lost her 30-year-old son &#8216;butch&#8217; &#8211; - who was killed by drunk driver while riding his motorcycle in colorado she says it still feels like it happened yesterday. now &#8211; she helps run the new mexico dwi victims memorial of perpetual tears. each marker represents a new mexico victim of a drunk driving crash. more than 8- hundred over the past 5 years. but soon, it will be a site of national signifigance, thanks to the help of senator tom udall and representative martin heinrich &#8220;i think it&#8217;s a tremendous thing that new mexico has done, we are a leader in the nation now in stopping dwi, so stigma be gone&#8221; minute thumbnail 10:16 pm britton says the visitors center has been closed for a long time &#8212; because state funding ran out &#8212; now she has to rely on private donors. but if this becomes a national memorial, britton says it opens the doors for more private and <b>&#8230;</b></div>
